Welcome to PingMoni! By accessing or using our services, you agree to these Terms of Service (“Terms”), which apply to both our marketing website (pingmoni.com) and application (app.pingmoni.com). If you do not agree, please do not use our services.
- Overview of Services
PingMoni provides uptime tracking and server resource monitoring services. Our platform includes a marketing website and a monitoring application where customers can configure and monitor their server and network performance.
- Account Eligibility
- You must be 18 years or older to create an account and use our services.
- You agree to use PingMoni only to monitor servers, networks, or systems that you own, control, or have explicit permission to monitor.
- Acceptable Use Policy
You agree to use PingMoni responsibly and in compliance with applicable laws and this AUP:
- Prohibited Activities:
- Using PingMoni to monitor servers, domains, or networks without authorization.
- Harassing, annoying, or disrupting other users, networks, or systems.
- Attempting to exploit, reverse-engineer, or interfere with our services.
- Feature Abuse:
- PingMoni provides various monitoring tools, including heartbeats and server resource checks, with defined intervals for usage. Abusing these features—such as attempting to bypass interval limitations—may result in restrictions, including the banning of IP addresses or suspension of accounts.
- The minimum allowed interval for heartbeats is 1 minute. Attempts to misuse this or other features beyond their intended design are considered a breach of this AUP.
- Security Obligations:
- You must keep your account credentials secure and notify us immediately if you suspect unauthorized access.
- Enforcement:
- For minor violations, we may issue warnings or temporarily suspend your account to allow corrections.
- Serious Violations: Actions deemed to be a serious violation of these Terms, even if not illegal (e.g., repeated feature abuse, unauthorized monitoring, or other significant breaches), may result in immediate account termination or restriction without prior notice.
- Payment and Refunds
- Payment for subscriptions is handled through Stripe. PingMoni does not store your payment details.
- Refund Policy: Paid subscribers may request a refund for the last 30 days of service if unsatisfied. Refunds are not available for free accounts.
- Data Retention and Deletion
- Data retention is based on your subscription level. Free accounts retain data for 30 days, while paid accounts may have extended or unlimited retention.
- You may delete your account at any time, which will purge all associated data except for records necessary for security or compliance (e.g., payment logs).
- Service Interruptions
While PingMoni aims for high availability, we cannot guarantee uninterrupted access to our services. Scheduled maintenance and unforeseen issues may cause temporary outages.
- Limitation of Liability
- For paid accounts: Our liability is limited to the amount you paid for the monitoring services during the most recent subscription period.
- For free accounts: We disclaim all liability for any use of our services.
- PingMoni is not liable for indirect, incidental, or consequential damages arising from the use of our platform.
- Termination of Service
- PingMoni reserves the right to suspend or terminate your account if you violate these Terms, applicable laws, or our Acceptable Use Policy.
- For Minor Issues: We will notify you and provide an opportunity to address the issue before taking further action.
- For Serious Violations: Immediate account termination or restrictions (e.g., IP bans) may occur without notice for violations including but not limited to:
- Illegal activities.
- Repeated or egregious breaches of the Acceptable Use Policy.
- Abuse of PingMoni features such as attempting to bypass monitoring intervals or disrupting services.
- Jurisdiction and Governing Law
These Terms are governed by the laws of the United States. Disputes arising from these Terms will be resolved under the jurisdiction of U.S. courts.
- Changes to Terms
We may update these Terms periodically. Continued use of our services after changes constitutes acceptance of the revised Terms.
